The Defence Representation bar is facing the challenge of providing adequate representation as state budgets for indigent defendants continue to shrink. While many fire departments, schools, parks and libraries have dedicated constituencies that fight for funding against cuts, there is no equivalent group for the indigent defense bar.
As a result, defense attorneys must work harder than ever to ensure that the rights of the accused are protected. To do so, they must be able to communicate complex legal concepts and procedures in ways that their clients understand. This is particularly critical during plea negotiations, when attorneys must explain the consequences of a guilty plea.

They must also be able to recognize when a client is not competent to make informed decisions about his or her case and refer the client to another lawyer. At all times, defense counsel should comply with the ethical rules and laws governing client confidentiality, loyalty, and candor, and should not disclose confidential information to third parties without authorization.
Moreover, defense attorneys should promptly inform their clients about plea offers and significant developments, motions or court actions and rulings. This includes any information that could prejudice a client’s case, such as the accused’s admission of guilt or his or her statements that he or she committed the crime.
